TERMS AND CONDITIONS OF SALE

The general terms and conditions of sale describe the process to be followed scrupulously and in full to order, pay, receive delivery and, potentially, return products ordered by non-professional customers on the www.kaliom.com website.

The general terms and conditions of sale can be consulted on the website www.kaliom.com.

Prior to any order, it is imperative that the Customer declares that they have read and accepted the general terms and conditions of sale.

In the event of a change to the general terms and conditions of sale, the date of the order determines the applicable version.

 

1 – The Customer

The Customer declares, under their sole and unique responsibility, to be:

• Either a natural person aged at least 18 years or, failing that, duly authorised by their legal representative
• Or a legal entity represented by its legal representative or any duly authorised agent

It is the Customer’s responsibility to confirm the accuracy of the information required, that relating to their identity and address, when creating their account.

KALIOM FRANCE shall in no case be held responsible for any error affecting the Customer’s details which would prevent or delay the delivery of the products purchased.

2- KALIOM products

The products offered for sale are those described and presented on the site www.kaliom.com.

It is up to the Customer to consult the description of each product to find out its properties and characteristics (capacity, composition, price).

The choice of products is the sole and unique responsibility of the Customer.

Kaliom has a unique ID number from ADEME for packaging : FR213639_01NLLG

3 – Order procedure

Any order placed on the website www.kaliom.com implies the respect of the procedure set up by the Company KALIOM FRANCE.

The order is validated and registered only after the last step of this procedure.

Consequently, it is the Customer’s responsibility to check their products, quantities, availability, price, and address, before validating it.

Any order validated and confirmed by the customer is considered firm, definitive, and irrevocably binding.

An acknowledgement of receipt confirming the registration and the purpose of the order will be sent to the Customer.

KALIOM FRANCE reserves the right to refuse any order coming from a customer with whom there is or would have been a dispute or a payment incident or which would contravene the present general terms of sale.

4 – Prices

The prices of the products are indicated in EURO inclusive of all taxes except participation in the carriage costs.

The total amount of the order (price of products ordered including all taxes and shipping costs) is indicated to the Customer at the end of the order procedure before it is validated.

The total amount of the order is also recalled in the acknowledgement of receipt sent to the Customer.

KALIOM FRANCE reserves the right to modify its prices at any time to take into account, in particular, the fluctuation of raw material prices.

The products ordered are, however, invoiced at the rate applicable on the day of the validation of the order.

An invoice will automatically be sent to the e-mail address indicated by the Customer when placing the order unless otherwise indicated by the Customer.

5 – Payment

The products ordered on the site www.kaliom.com are payable in full, including shipping costs, on the day of the order.

No delivery will be made unless full payment has been received in advance for the products ordered and the shipping costs.

Orders can be paid by:

• credit card. The Customer will then be asked to complete the fields provided for this purpose (card number, expiry date, cryptogram)
• In this case, no banking information concerning the Customer is transmitted to the online sales site www.kaliom.com of KALIOM FRANCE.

No other mean of payment is allowed and KALIOM FRANCE reserves the right to refuse any order whose payment would not comply with the above terms.

6 – Delivery

The delivery is made to the delivery address indicated by the Customer under their sole responsibility.

The delivery address must correspond to the Customer’s home address.

No deliveries will be made to hotels or post office boxes.

Deliveries are made by an independent forwarding agent.

Therefore, the delivery times indicated are only indicative and correspond to the average processing and delivery times.

Upon receipt, the Customer must check the condition of the products delivered. They have a period of fifteen days to inform KALIOM FRANCE of their reservations concerning the conformity or the existence of apparent defects.

After this period, and in the absence of reserves or claims expressed to KALIOM FRANCE, the products will be deemed compliant and free of any apparent defect.

No further claim will be accepted.

7 – Right of withdrawal

The Customer has a right of withdrawal which they may exercise without reason within fourteen days from the delivery of the order.

The return costs are at the expense of the Customer.

Products returned to KALIOM FRANCE must be in perfect condition for resale (not damaged or used by the Customer).

They must be accompanied by a copy of the order and delivery forms.

Products returned to KALIOM FRANCE will be refunded to the Customer within a maximum period of thirty days from receipt of the return.

KALIOM FRANCE reserves the right to refuse the reimbursement of products which would not be returned intact or which would not be accompanied by the required documents.

Refunds are made according to the same method of payment chosen by the Customer.

8 – Force majeure

Under no circumstances may KALIOM FRANCE be held responsible for the non-fulfilment of the order in case of force majeure. By express agreement between the parties, the unavailability of one or more products, strike movements, theft or loss by the carrier, natural disasters, wars, pandemics, riots, fires, stock shortages are considered to constitute force majeure.

9 – Applicable law

The present general conditions of sale are subject to French law.

In the event of a dispute, only the French Courts will be competent.

However, KALIOM FRANCE prefers to find an amicable solution.

Also, in the presence of a difficulty or a complaint arising during the execution of an order, it is strongly recommended that the Customer first contact Customer Service (contact@kaliom.com or +33 (0)1 48 24 59 13).

10 – Data processing and liberties

The information collected by KALIOM FRANCE during a Customer’s order is essential for the management of the transaction. This information may be communicated in whole or in part to the service providers of KALIOM FRANCE involved in the execution of the order.

The Customer is informed that this same personal data may also be collected by an organisation in charge of analysing orders and combating credit card fraud.

In accordance with the French Data Protection Act No. 78 – 17 of 6th January 1978, the Customer has the right to access, rectify, oppose, and delete data that relates to them.
